Service Agreement

FSBO Desoto Homes is an advertising service.  We represent neither the buyer nor the seller.

We assist the “For Sale By Owner” process by providing internet exposure to buyers and sellers in the Desoto County area.  We are not realtors, and except for the initial fee/renewals, we do not receive any additional compensation from buyers or sellers.  Verification of the information for any property in which you may be interested is your responsibility alone.

1. Our Standard package is $250 for a duration of three months, or until the property is sold, taken off the market, or listed with a real estate agent or broker, whichever comes first.

2. Our Deluxe package is $350. If you are not comfortable with the computer, this is the plan for you. This plan has additional features not included in the Standard package.  This plan is for a duration of three months, or until the property is sold, taken off the market, or listed with a real estate agent or broker, whichever comes first.

• The listing may be renewed for an extended period of 3 months for a fee of $100.
• Listings are for one property and are non-transferable.
• Property owners must agree not to list their property on any other website.
• Owner is responsible for the accuracy of all information posted on the fsbodesotohomes.com website.  Any owner deliberately misrepresenting their property will be asked to change the inaccuracy.  Refusing to do so will result in termination of the listing.
• No warranty of any kind is implied or provided.
• No refunds are given, due to all expenses being incurred during the first week of a new listing.
• Any user submitting a bad check or credit card will be charged a fee of $50 and may be unable to access FSBO Desoto Homes’ website in the future.

3. We feel that every seller needs to give their home as much exposure as possible, so we welcome you to advertise your home as you see fit.  However, FSBO Desoto Homes reserves the right to terminate a listing if our sign is removed from the property.

4. The Yard Sign, Frame and Riders are the property of FSBO Desoto Homes. A fee of up to a $100 may be assessed for any yard signs that are unavailable for pickup after the listing term expires or are damaged beyond normal wear and tear.

5. When an offer is accepted on the property, seller agrees to hang a “Sale Pending” rider on the yard sign.  (This will be provided by FSBO Desoto Homes).

6. Seller agrees to hang a “Sold” rider (provided to you by FSBO Desoto Homes) on the FSBO Desoto Homes Yard Sign after closing.

7. You agree to call (662) 895-1220 or email us at info@fsbodesotohomes.com and let us know that we can remove the yard sign and pick up the additional sign materials, (i.e. directional signs, riders, etc.).  Also let us know where we can pickup the additional sign materials, (sign materials will be placed on the front porch).  Once your home has sold, or your listing expires, please allow 5 business days for your property to be removed from our website and for our signs to be picked up.

8. Additional yard signs and directional signs are available for an additional cost.  Please contact us for further details.

9. To change your listing to SOLD, please login to your account and follow the instructions.  It is your responsibility to keep your information accurate and up-to-date.

10. Username and Password:  if you forget your username or password, please email us at info@fsbodesotohomes.com so we can reset your account.

11. Property owners agree to mark a safe location for the Yard Sign to be installed (using a flag or wooden stake) and takes responsibility for any damage to underground utilities, sprinkler pipes or hidden objects.  Call your local utility company to mark underground utilities.  FSBO Desoto Homes shall not be responsible for any injuries that may occur with this sign.

12. Most signs will be placed within 5 days.

13. Properties listed with real estate agencies or brokers cannot be listed on the FSBO Desoto Homes website.  Any property that is found to be listed with a real estate agent or broker will be removed from the site and have all signs removed from their property.

14. FSBO Desoto Homes shall not be held responsible for any accidents or injuries that may occur to the Buyer or Seller during the selling or showing of a property.

15. Service is for one property only, and non-transferable we do offer plans for builders.
